1. Who you are contracting with
PodDesk is provided by Goodley Productions ("we", "us", "our"). By accessing or using PodDesk, you are entering into an agreement with Goodley Productions and agree to these Terms & Conditions.
2. Acceptance
By creating an account or continuing to use the service, you accept these terms. If you are using PodDesk on behalf of an organisation, you confirm you have authority to bind that organisation. You must be of legal age to enter into this agreement.
3. The service
PodDesk is a workspace for podcast hosts to manage guests, episodes, AI-assisted outreach, intake forms, briefs, and invoicing. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you select.
4. Acceptable use
You must not misuse the service. This includes, but is not limited to, unlawful use, fraud or spam, infringing the intellectual property of others, and interfering with the security of the service (for example through malware, probing, or scraping). You are responsible for keeping your account credentials confidential and for activity under your account, and for providing accurate information.
5. Intellectual property
We retain all ownership of the service and its intellectual property, including software, documentation, and branding. You retain ownership of the content you create, and you grant us a limited licence to host and process that content solely to provide the service.
6. Payment and subscription terms
Paid plans are billed on a recurring basis until cancelled. Payment, billing, tax, cancellation, and refund mechanics are handled by our reseller Paddle and are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. See our Refund Policy for refund details.
7. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Service level and warranties
We work hard to keep PodDesk available, but we do not guarantee that the service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, you may export your data within a reasonable window, after which it may be deleted.
10. Liability
To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim, and we exclude liability for indirect, consequential, or special damages. Nothing in these terms limits liability that cannot be excluded by law.
11. Governing law
These terms are governed by the laws of the jurisdiction in which Goodley Productions is established, and disputes are subject to the courts of that jurisdiction.
